Coldture Plunge All-In-One Residential 1-Year Limited Warranty

Warranty Overview

Coldture Wellness Inc. (“Coldture”) warrants to the original residential purchaser that the covered product and its factory-installed component parts will be free from defects in materials and workmanship for one (1) year from the original date of delivery, subject to the terms, conditions, exclusions, and limitations set out in this Limited Warranty.

This warranty applies exclusively to residential use and is subject to the product-specific operating, installation, maintenance, and winterization requirements outlined below.

Products Covered and Temperature Requirements

This warranty applies to the following Coldture All-in-One plunge products:

Indoor Models

• Pro Plunge

• Pro Lite

Outdoor Models

• Outdoor Xtreme XL

• Outdoor Xtreme

• Dual Contrast System

Indoor Models: Pro Plunge and Pro Lite

The Pro Plunge and Pro Lite are designed for indoor use and are not designed or rated to operate in ambient temperatures below freezing (0°C / 32°F).

These models must be installed, operated, and maintained in an environment that remains above freezing and in accordance with the applicable Coldture product manual.

The owner is responsible for ensuring that the unit and its water-containing components are not exposed to freezing conditions. These indoor models must not be operated or left in an environment where the unit, plumbing, pump, chiller, or other water-containing components may freeze.

Damage resulting from operation or storage in below-freezing ambient temperatures, exposure to freezing conditions, or failure to protect the unit from freezing is excluded from warranty coverage.

Outdoor Models: Outdoor Xtreme XL, Outdoor Xtreme, and Dual Contrast System

The Outdoor Xtreme XL, Outdoor Xtreme, and Dual Contrast System are designed for outdoor operation in temperatures as low as -35°C (-31°F), provided that the unit is properly installed, maintained, winterized, and operated in accordance with the applicable Coldture product manual and winterization instructions.

The -35°C temperature rating is conditional on proper operation and winterization. It does not guarantee protection against freezing damage if the unit loses power, shuts down, experiences an equipment failure, is improperly winterized, or is otherwise operated contrary to Coldture's instructions.

The owner is responsible for ensuring that all required winterization procedures are completed and that the unit is operated in accordance with the instructions applicable to the specific model.

Owner Responsibility

The owner is responsible for identifying the applicable product model and following all instructions relating to installation, operation, maintenance, temperature limits, and winterization.

Failure to follow the applicable product manual or Coldture's written operating instructions may result in damage that is excluded from warranty coverage.

Warranty Coverage

For one (1) year from the original delivery date, Coldture warrants the following factory-installed components against defects in materials or workmanship.

Shell Structure

The shell is warranted against water loss caused by defects in the shell, blisters, cracks, or delamination of the interior surface resulting from defects in materials or workmanship.

Equipment and Controls

The pump, chiller components, heater, sensors, and control system are warranted against malfunctions caused by defects in materials or workmanship.

Plumbing Components

Factory-installed plumbing components are warranted against leaks caused by defects in materials or workmanship.

Water Purification System

The factory-installed water purification system is warranted against malfunctions caused by defects in materials or workmanship.

Other Factory-Installed Components

Other factory-installed components not specifically listed above, including the frame, jets, diverter valves, lighting systems, filter shield, filter lid, and mechanical components, are warranted against malfunctions caused by defects in materials or workmanship.

Warranty Limitations and Exclusions

This Limited Warranty does not cover the following:

1. Products located outside Canada or the United States.

2. Freight or carrier damage that is not reported to Coldture within 24 hours.

3. Damage resulting from repairs, alterations, or relocation attempts performed by anyone other than Coldture or an authorized Coldture representative.

4. Damage caused by neglect, misuse, abuse, improper installation, or failure to follow the owner's manual or other applicable Coldture instructions.

5. Damage resulting from improper water chemistry or the use of abrasive cleaners, unauthorized cleaning products, or unauthorized parts.

6. Coverage for insulating covers or items installed after manufacture.

7. Normal wear and tear or cosmetic damage, including scratches, stains, discoloration, or chipping, that does not affect product performance.

8. Failures or damage resulting from events beyond reasonable control, including flood, fire, lightning, earthquake, tornado, theft, or vandalism.

9. Costs associated with adjustments, preventive maintenance, or gaining access to components.

10. Property damage caused by condensation or by installing the All-in-One plunge on a non-waterproof surface.

11. Products used in commercial settings.

12. Labour, installation, tariffs, removal, access, or on-site service fees, unless expressly authorized in writing by Coldture.

13. Damage caused by freezing, ice formation, improper winterization, operation outside the product's specified environmental limits, failure to maintain required operation during freezing conditions, or failure to drain the unit and relevant water-containing components immediately after a shutdown or power loss during freezing conditions.

These exclusions apply to the extent permitted by applicable law. Where appropriate, a coverage decision will be based on whether the excluded condition caused or contributed to the failure or damage at issue.

Voiding the Warranty

Warranty coverage may be denied for the affected failure or damage if the product has been:

1. Used in a commercial application without prior written notice to and authorization from Coldture.

2. Modified, altered, or repaired using non-Coldture parts or by an unauthorized person, where the modification, repair, or unauthorized parts caused or contributed to the issue.

3. Maintained contrary to the requirements in the applicable user manual.

4. Operated contrary to the temperature, winterization, or freeze-protection requirements set out in this warranty or in the applicable product manual.

5. Left with stagnant water, or not properly drained during a planned or unplanned power loss for 48–72 hours in temperatures above 3°C, where the failure to drain causes or contributes to the damage.

6. Operated without changing filters at least every 30 days, or with a filter not authorized by Coldture, where this causes or contributes to the failure.

7. Subjected to improper water chemistry resulting in chiller failure.

8. Operated with ice added directly to the tub while the unit is running.

Failure to follow the applicable instructions may affect coverage for the resulting failure or damage. Nothing in this section is intended to exclude or limit rights that cannot lawfully be excluded or limited under applicable law.

What Coldture Will Do

Upon reviewing a claim and verifying eligibility under this Limited Warranty, Coldture will, at its discretion and subject to applicable law, repair or replace the defective covered component.

Replacement parts approved under this Limited Warranty will be supplied at no charge. Coldture will cover standard shipping costs for approved warranty replacement parts.

Labour, installation, removal, access, tariffs, and on-site service costs are not covered unless expressly authorized in writing by Coldture or otherwise required by applicable law.

The owner is responsible for providing safe and reasonable access to the product for inspection, servicing, or repair.

How to Make a Warranty Claim

To submit a warranty claim, the owner must:

1. Contact the retailer, distributor, or Coldture directly through the support form at https://coldture.com/pages/support-form.

2. Provide proof of purchase, such as a receipt or order confirmation.

3. Provide a written description of the defect or issue, including photos or video where available.

4. Include the order number and purchase date.

Coldture may request additional information, photographs, videos, or other reasonable documentation to assess the claim and determine whether the reported issue is covered by this Limited Warranty.

Limitations on Implied Warranties

This Limited Warranty replaces other express warranties relating to the covered Coldture product.

No dealer, service agent, or other party is authorized to modify or extend the terms of this warranty unless Coldture provides such modification or extension in writing through an authorized representative.

Warranty service must be performed by Coldture or an authorized representative using genuine Coldture parts.

Nothing in this section excludes or limits any warranty, condition, guarantee, or right that cannot lawfully be excluded or limited under applicable law.

Disclaimers and Limitation of Liability

• Coldture is not liable for incidental or consequential damages, including property damage, loss of use, or costs for removal or disposal.

• Liability under this warranty does not exceed the original purchase price of the defective product.

• Coverage begins on the original delivery date and does not extend beyond the stated warranty period.

Legal Rights 

This warranty gives you specific legal rights. Other rights may vary by province or state. Some states/provinces do not allow limitations on how long an implied warranty lasts or the exclusion of incidental/consequential damages.

Governing Law 

This Limited All-in Coldture Plunge Warranty shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws

of Canada applicable therein. Any disputes arising under or in connection with this warranty shall be resolved exclusively in the courts of Ontario.

Entire Agreement 

This document constitutes the entire agreement between Coldture Wellness Inc. and the purchaser with respect to the warranty of the product and supersedes all prior representations or agreements, whether written or oral.

No change to this Limited Warranty is effective unless made in writing and authorized by Coldture, subject to applicable law.
